GLOBAL CARGO IS LEAVING ON A JET PLANE

With the ongoing threat of COVID-19, airlines have seen a precipitous drop in passenger travel and are focused on the possibility of a voluntary or mandated halt to U.S. passenger flights. In response, major carriers are finding ways to keep flying during the global health crisis.

American Airlines and United Airlines, for example, have offered their passenger aircraft for charter cargo flights. Even in normal times, the lower deck of passenger aircraft carries cargo to maximize the utilization of space. With the sharp scale-back in passenger travel, however, the companies are offering dedicated cargo runs to deploy their assets and replace revenue while helping to keep supply chains moving and facilitate the shipment of essential goods.

Attention All Passengers:

Many air travelers don’t realize that it’s not just their own and fellow travelers’ luggage that checked in for their flights. The big passenger airlines generally have a lot of available space in their bellies. With operating costs covered by passenger tickets, the airlines often generate supplemental revenue by carrying packages, freight or mail for the U.S. postal service on board passenger flights.

In turn, cargo shippers secure relatively cheap space and can get goods close to their ultimate destination given the dense network of airports serving passenger flights around the world. Even logistics players like UPS and FedEx partner with passenger airlines, particularly in emerging markets where trade volumes may not justify the deployment of their own regularly-scheduled aircraft. Technology tools enable precise coordination to ensure goods off-loaded from a freighter aircraft make their departure on a passenger aircraft and vice versa.

Cargo split

The trend is taking off. The International Air Transport Association (IATA) has been cited as estimating the split between cargo carried by passenger airlines and freighter aircraft at 60/40 and forecasts that will grow to 70/30 in the coming years.

In 2018, American Airlines moved 2 billion pounds of cargo and raised $1 billion of cargo revenue despite not operating cargo aircraft. Airlines based in Asia such as Korean Air and Cathay Pacific do have freight fleets, but still carry more than half of their cargo in the bellies of passenger aircraft. McKinsey has noted that with the expansion of the major Middle Eastern passenger carriers and new aircraft designs with large belly-cargo configurations, the belly capacity of Middle Eastern carriers flying into Europe in 2016 equaled the capacity of more than 100 weekly Boeing 777 freighter flights.

Open Skies

“Open Skies” agreements governing the transport of people, pallets and packages are designed to enable market forces to guide decision-making about routes, capacity, and pricing. Critically, Open Skies agreements also provide both passenger and cargo flights unlimited market access to partner markets and the right to fly to all intermediate and beyond points. The United States now has Open Skies agreements with over 100 partners around the world, including both bilateral agreements and two multilateral accords. So-called fifth freedom rights – also called beyond rights – are a core element of Open Skies agreements, permitting a carrier to fly to a second country, offload passengers and cargo, pick up new passengers and cargo, and continue on to a third country.

While Open Skies agreements provide benefits to both passenger and cargo carriers, cargo carriers to a large extent fly international packages and freight themselves, while passenger carriers utilize codeshare agreements and worldwide alliances. The different business models and complex tie-ups can produce a divergence in interests. A prominent example was the dispute between the “Big Three” U.S. passenger carriers – American, Delta, and United – and the governments of the United Arab Emirates (UAE) and Qatar, who the carriers alleged were providing billions of dollars in subsidies and other benefits to their state-owned carriers: Emirates, Etihad, and Qatar Airways. Among other serious concerns, this raised red flags about subsidized fifth freedom operations (e.g., Newark-Athens-Dubai) and the potential for their expansion, negatively impacting U.S. passenger airline service to the Middle East and India.

U.S. Airlines for Open Skies, a coalition that included FedEx, Atlas Air, the Cargo Airline Association and JetBlue (which has a code-sharing agreement with Emirates), opposed the call of the Big Three for restricted Gulf fifth freedom rights (a violation of the U.S.-UAE and U.S.-Qatar Open Skies agreements if restricted involuntarily). The cargo carriers expressed concern that challenges to the Open Skies accords with Qatar and the UAE put at risk the fifth freedom rights that cargo carriers depend on for their complex global networks. They discounted the view that the U.S. could breach passenger fifth freedom rights without setting a dangerous precedent for the equivalent all-cargo rights.

The dispute was ultimately resolved in 2018 through U.S. government agreements with the Qatar and UAE governments under which the parties acknowledged that government subsidies adversely affect competition and committed to financial transparency and business on commercial terms.

Air cargo capacity is critical at this time of crisis and the airlines’ role is deemed a critical infrastructure industry by the Centers for Disease Control and Prevention (CDC). American Airlines reports that its recent cargo-only charter carried medical supplies, mail for active U.S. military, and telecommunications equipment and electronics to support people working from home. United’s wide-body charter cargo flights are likewise getting critical goods into the hands of businesses and people in need. Stakeholders across the cargo and passenger industries look forward to a post-pandemic era where all can return to their respective roles in transporting people and cargo globally, described well by United’s slogan “Connecting People. Uniting the World.”

As the coronavirus pandemic is engulfing the world, it is adversely affecting the very structure of our society across the globe in a hitherto unprecedented way. The countries and international organizations around the world are trying hard to halt the progress of this pandemic.  According to experts, more people are likely to stay at home in light of the COVID-19 pandemic, which will reduce the demand for cars. Automakers have yet to see the impact of the pandemic and the real impact may only come out in the coming months. Here are the five most severe impacts of the coronavirus on the car industry.

1. Lockdowns and Curfews

Several governments across the world are imposing lockdowns and curfews in the respective countries to try and limit the spread of the virus among the population. The mode of transmission of the coronavirus is from one person to another. Since the coronavirus is highly infectious, there is a need for people to keep their distance from each other.

The places that people tend to crowd are extremely susceptible to be hotspots of transmission of the disease to many other people. Hence the doctors around the world are advising the population to follow the norms of social distancing. Cleaning your hands regularly with sanitizers or soaps to prevent the transmission of the virus is a crucial prevention method.

People do not want to go out shopping and in the U.S., the places with the maximum reports of coronavirus are already witnessing a drop in demand. Since the lockdowns are affecting the general way of life of people and there is no need for people to purchase a car in these times, it is leading to a natural decline in demand for cars and bikes such as the Yamaha wr250r.

2. Economic Slowdown

The countries across the world are facing a crisis, and the panic is causing an economic slowdown across the world. The slowdown is also causing the stock markets around the world to take a hit. Economic slowdowns always adversely affect the car industry as people tend to find a decrease in wealth for making such purchases. Even if the world recovers from the coronavirus pandemic, the economic impact is bound to cause ripples for months to come.

Although the long term effects of the pandemic are still unclear, car manufacturers are expecting only a delay in the purchases against people refraining from making the purchase. The reason for this expectation is that the people buy cars only due to their need for a car and not on a whim and hence can not postpone their purchase indefinitely.

3. Closing Down of Factories

In order to stop the spread of the virus and curb the transmission, the various countries are shutting down the factories operating in their state. Since there is a need for workers to be present and working in factories for ensuring smooth and continuous production of cars, manufacturing is not going on. China is a major hub of car manufacturing, and as the disease originates from the country, many plants are shut down.

Many workers come in close contact in manufacturing plants, and hence they can act as hubs of disease transmission. Only the essential services are operational for limiting close human interaction and slowing down transmission. This is slowing down the manufacturing of cars around the world.

4. Need for Medical Equipment

Due to the sudden onslaught of the coronavirus pandemic, there is a sudden surge in demand for emergency medical equipment and protective gear. Many factories are also now producing face masks and ventilators as they are in acute shortage and are currently in high demand. Since the repurposing of factories is taking place, car manufacturing is coming to a standstill.

The manufacturers are not able to use their production line for the manufacture of cars. Hence, they can easily repurpose their plants to make the medical necessities by making slight modifications to the production line. They will need an expert to monitor and guide the production as the ventilators are complex machines. Manufacturers are working closely with government officials and health authorities for the production of ventilators.

5. Slow Down of International Trade

Due to the effect of globalization, every industry sources their raw materials and individual parts in different countries throughout the world for keeping the manufacturing cost low. Since some countries are stopping the production of materials due to the coronavirus, manufacturing plants all over the world are facing acute shortages.

The manufacturing plants of cars in other countries are also facing a shortage of parts and raw materials due to international trade restrictions in light of the current situation. This leads to the slow down or temporary stopping of the manufacturing process of cars around the world.

The virus is already present in every inhabitable continent throughout the world and almost every country is seeing a rapid spread of the disease amongst its population. As so, every country is imposing restrictions on the people venturing outside their homes for work and other needs to limit the spread of the pandemic.

The automobile industry is responding to the calls from the government to aid in manufacturing the face masks and ventilators in these trying times. The global economy is suffering and approaching a standstill due to the coronavirus pandemic and the automobile industry is also undergoing a crisis. As a responsible citizen, you must adhere to the regulations for curbing the spread of the disease and get back to normalcy in the fastest possible time.

How Companies can Rethink Supply Chains to Deal with Disruptions

The coronavirus has disrupted U.S. companies in many ways, and nearly three-fourths of them have seen their supply chain significantly affected.

While China has begun slowly reopening as the number of coronavirus cases there decreased in recent weeks, reports of the illness shot up in other countries, and the epicenter of the pandemic shifted to Europe and then the U.S. Thus, multiple supply chains have been compromised as the outbreak spreads, and there’s no telling when those links in the various chains will operate at normal capacity.

“There are waves of effects coming even if Chinese manufacturing gets back to full-go,” says Hitendra Chaturvedi, a professor at the Supply Chain Department of W.P. Carey School of Business at Arizona State University and an expert on global supply chain sustainability and strategy.“As the coronavirus has spread globally, drops in different trading partners’ ability to supply is felt everywhere.

“What this is showing, especially in the U.S., is we need to reassess supply chain strategy and make it stronger to withstand unforeseen, major disruptions.” Chaturvedi outlines some possible outcomes in U.S. supply chain strategy as a result of the coronavirus:

Learning that cost is not the only consideration. Chaturvedi says that when companies in the future plan their overall global supply chain strategy, they may decide that paying more to establish a more resilient and flexible process would be worth it by reducing risk. “Companies typically find the lowest-cost supplier, but if you have a single source, you’re vulnerable, and that’s what’s happening now,” Chaturvedi says. “This will move companies more toward mitigating risk. That requires making investments. They could stabilize their supply chains by enlisting alternative suppliers, boosting inventories or investing in more diverse ways of distribution.”

Localizing more manufacturing and transporting. “Dependence on China for their manufacturing has put small and midsize businesses in jeopardy,” Chaturvedi says. “The pandemic exposes the vulnerability of companies that rely heavily on a limited number of trading partners. What will result is businesses will look to restructure their global supply chains, and some companies will look at localizing more than they would have in the past. A shift in that direction had already started during the U.S.-China tariff fight.”

Planning for future disruptions. Another result of the pandemic’s impact on supply chains is it will compel companies to anticipate disruptions in the future and build in quick responses to their supply chain. This involves a process called mapping, in which companies engage suppliers in order to better understand their sites and processes. “It’s imperative for businesses running a global supply chain to be in the know about news that could cause disruptions,” Chaturvedi says. “You have to be proactive and not reactive. Knowing where the disruption will come from and how that will impact their products allows companies to lead time and the ability to create a mitigation strategy.”

Utilizing technology. Chaturvedi expects to see a rise in the use of AI, chatbots, the internet of things, and robotic process automation to facilitate supply chains. “This will be done not only as a pretext to bring manufacturing jobs back from China,” Chaturvedi says, “but also for purely selfish reasons because bots do not get sick.”

“The impact of the coronavirus pandemic on supply chains has given new meaning to the word ‘disruption,” Chaturvedi says. “We’ve never seen anything quite like this, and businesses can learn a lot from it that will help their supply chain process in the future.”

Customs Changes Course: No Longer Accepting Requests to Defer Duty Payments

On Friday, March 20, 2020, Customs announced that it was accepting requests for short-term relief from payment of estimated duties, taxes and fees due to the COVID-19 emergency, as discussed here.

Nevertheless, on March 26, 2020, Customs issued “Additional Guidance for Entry Summary Payments Impacted by COVID-19” that revised the information and policy in the earlier announcement. In its “Additional Guidance” Customs stated that it was no longer accepting requests for additional days for payment of estimated duties, taxes, and fees, but commented that CBP retains the right to allow additional days for payment in narrow circumstances, such as physical inability to file entry or payments, based on technology outages or port closures.

Single payments, daily and periodic monthly statement payments of estimated duties, taxes and fees that should have been tendered from 3/20/2020 through 3/26/2020, payment must be initiated by 3/27/2020. Trade members who did not pay Customs for estimated duties, taxes and fees from 3/20/2020 through 3/26/2020 must initiate payment by 3/27/2020.

Separate from reversing its policy on a limited number of “additional days” for duty relief, we also reported that CBP was considering a more extended 90-day tariff relief plan. Recent reporting, though, indicates that this 90-day tariff relief plan has been shelved. We understand that a number of senior administration officials (including Treasury Secretary Mnuchin and economic adviser Larry Kudlow) were in favor of granting the relief, but were outweighed by others within the Administration (Peter Navarro) as well as influential individuals in the private sector aligned with more protectionist policies.

How Downtime Forced by Coronavirus Could Be An Entrepreneurial Opportunity

For would-be entrepreneurs who have longed to turn a side hustle into their main hustle, the shutdown created by the coronavirus may have provided that long-awaited opportunity.

Often, a lack of time is one of the major reasons people give for not starting their own businesses. But these days – with everyone urged to stay home and outside activities limited – those newfound extra hours could be invested in taking steps toward creating that business, says Shravan Parsi, CEO and founder of American Ventures, a commercial real estate company, and ForbesBooks author of The Science of the Deal: The DNA of Multifamily and Commercial Real Estate Investing (www.scienceofthedeal.com).

“It definitely takes effort, energy, and a willingness to step out there, but the rewards can be great,” Parsi says.

Parsi was a full-time pharmaceutical research scientist working 9 to 5 and dabbling in real estate on the side when he realized his regular job was hampering his real estate deals because he wasn’t available to talk with people or show a house during the day. Eventually, he bid farewell to his old career and launched his new one in commercial real estate.

Parsi has a few tips for those who long to shake loose from their current careers and venture into something that drives their passions:

Be bold and flexible. A willingness to take chances and adapt to changing circumstances is critical. Even in seventh grade in his native India, ambition boiled in Parsi. He realized that to become the kind of global leader he aspired to be, he would need to know English. So, he transferred to an English school. “My parents supported my decision even though they knew it would be challenging,” he says.

Be interested in everything and observe closely. You never know when opportunities to expand your knowledge – and be inspired by new ideas – will present themselves. Parsi says he learned this lesson at age 14. His father was a doctor who himself invested in real estate as a passive investment and was having a two-story house built – one story for the family and one as a rental. “He pointed out that I had time to kill over summer vacation and recommended I watch the process,” Parsi says. “So my brother and I watched the construction and supervised the contractors. It left a strong impression on me.”

Pivot when necessary. Life doesn’t always go as planned – as the coronavirus has shown – so you need to be prepared to change direction, Parsi says. As an example, Parsi originally planned to follow in his father’s footsteps and become a doctor. But admission to medical school in India is highly competitive and he missed the cutoff criteria by one-tenth of a point. That’s when he pivoted and became a pharmaceutical scientist instead.

Learn how to sell anything. At different periods in his life, Parsi worked in a cell phone store, sold Amway products, and sold nutritional supplements. Those experiences weren’t always the best, he acknowledges, but he did gain something from them. “I realized that if I can sell the products and a story and recruit others, then I can sell anything,” Parsi says. “Selling is a pivotal skill most entrepreneurs must have.”

Anyone who is inspired to get their entrepreneurial drive moving during the current downtime should not completely throw caution to the wind, Parsi says.

“I did not quit my pharmaceutical job right away,” he says. “I had an objective to stay in that job until the real estate income was twice the value of my salary. When I hit that objective – when real estate was no longer a side hustle – I decided it made sense to invest more time in real estate than the scientific position.”

Now American Ventures is a successful multifamily and commercial real estate investment firm with a proven track record.

“Never settle for less,” Parsi says.

What Employees Are Expensing During the COVID-19 Outbreak

As the situation surrounding COVID-19 has progressed, more travel restrictions and social distancing practices are being implemented every day. More and more companies are implementing work-from-home policies to adapt to the changing situation.

We’ve been tracking the data since the beginning of the crisis to help your company ensure employee health and safety and make essential decisions around expenses.

Here are a few of the most significant changes we’ve seen.

COVID-19 expenses haven’t shown any sign of slowing down

In our last blog, we noted that COVID-19 expenses skyrocketed, and we expected them to fall as trip cancelations began to taper off. However, these expenses have shown no sign of slowing down. COVID–19–related expenses have doubled from the week ending March 7 to the week ending March 14, with trip cancelation and work-from-home expenses being the primary causes.

Although changes to travel plans and cancelations still make up over half of all COVID-19-related expense claims overall, the trends change when you look at specific industries.

In the finance and software industries, half of the expenses are related to travel cancelations, and the other half are work-from-home expenses.

In the consumer goods, manufacturing, and pharmaceutical industries, masks still make up 15 to 20% of expenses but are otherwise in the low single digits in other industries.

The growth in expenses also varies by industry.

Work-from-home charges have increased dramatically; masks have fallen

Work from home expenses have grown the most, increasing 3.5x since last week. These charges are mainly related to “remote office setup” or “supplies for remote work,” and include accessories like printers, ink, headphones, and HDMI cables.

In our own workforce, we’ve noticed that everyone has a different set-up at home, ranging from at-home offices to sitting with their spouse at the dining room table or even sitting in bed with their laptops. It’s essential to employee productivity and ergonomics to help everyone make the best of whatever space they have.

Mask expenses have fallen – there was a peak in mid-February, then another dip, and a second peak at the end of February.

What does this data mean for my company’s expense policy?

We hope this data can help you consider the appropriate response to COVID-19 in your organization and how you can best support your employees. It’s clear from the above data that work-from-home expenses are increasingly common, and will likely continue to increase over the next few weeks as more companies continue to close their offices temporarily. We’ve also noticed that several companies have created specific expense types to track COVID-19 spending more closely. Others have created expense categories for their accounts payable departments to pay temporary workers more quickly in times of uncertainty.

USTR Considers 301 Tariff Exemption Requests for COVID 19 Medical Supplies

As the country faces the global health crisis caused by the COVID-19 outbreak, recent announcements by the Office of the U.S. Trade Representative (“USTR”) signal the possibility of some relief from special tariffs on imports from China. Since July 2018, as reported previously here, the Trump Administration has imposed tariffs under Section 301(b) of the Trade Act of 1974 on nearly all U.S. imports of Chinese goods, including medical supplies that are now in high demand because of the outbreak.

USTR based the tariffs on its findings in an investigation of China’s acts, policies, and practices related to technology transfer, intellectual property, and innovation. There have been four rounds of tariffs, broadening the scope of products that are affected. With each round, USTR allowed requests for exclusion of particular products that are not adequately available in the United States.  Prior to the most recent announcements, the opportunity to request exclusions from any or all of the four lists had lapsed, but USTR continued to consider whether to grant requests that had already been filed but remained outstanding.

National priorities have changed as the COVID-19 outbreak in the United States has worsened, increasing the need for medical supplies. On March 25, USTR published a notice of the opportunity to request additional exclusions for products expected to be helpful in responding to the crisis.

Requests can be made through the online portal regulations.gov, but the window closes June 25, 2020, unless extended. Requests “specifically must identify the particular product of concern and explain precisely how the product relates to the response to the COVID-19 outbreak. For example, the comment may address whether a product is directly used to treat COVID-19 or to limit the outbreak, and/or whether the product is used in the production of needed medical-care products.” Decisions will be made on a rolling basis. Any responses to exclusion requests should be submitted within three business days after a request is posted.

In addition, USTR states that it has been prioritizing, in consultation with the U.S. Department of Health and Human Services, the processing of previously filed exclusion requests “addressed to medical-related products related to the U.S. response to COVID-19,” granting approximately 200 separate exclusions on March 10, 2020, March 16, 2020, and March 17, 2020. Products excluded in this manner have included medical masks and other personal protective products.

Surviving and Thriving in Quarantine: 3 Ways Businesses Can Turn Time into Opportunity

At this point, the story is global – businesses in communities around our country and world have shuttered, many at the direction of local, state or national governments as we battle the COVID-19 pandemic.

But grim as the picture may be today, millions of small business owners around the country need to grapple not just with the challenge of what to do while their operations are closed, but how to prepare for what lies on the other side of this crisis as the world emerges from quarantine and returns to the business.

In pursuit of a silver lining during this trying time, below are three opportunities to turn a quarantine shutdown on its head and help build businesses stronger than ever before.

Explore creative new ways to deliver your product or service – I’ve watched with fascination as many creative businesses have found ways to continue operating through a quarantine. Novel ways to deliver everything from orchestral music to personal training and therapy/addiction treatment have made the rounds as viral social media videos or popular articles. A similar solution may not be realistic for all businesses, but particularly if you deliver personal services (as opposed to hard goods and products that require in-person consumption), taking the time to invest in and perfect your digital delivery right now could pay benefits down the road.

Imagine a local personal trainer that works via in-person training sessions exclusively. These weeks (or months) may force their training sessions with existing clientele to video-conference, but if that trainer is intentional about streamlining their online offering they’ll be able to tap into a national (or international!) new customer base during and even after the quarantine ends.

Embrace any opportunity to explore an alternative delivery method for your businesses’ product or service, and you may reap benefits down the road.

-Take the time to complete bigger tasks you’ve been pushing off – there are some projects that are just hard to do when you are engaged in the full-time business of helping customers and producing a product each day. Large manufacturing facilities at companies like GE, Ford, Boeing, and more understand this as a fact of life – they proactively schedule dedicated plant-shutdown weeks where assembly lines stop completely to create space for large projects that wouldn’t be possible during normal operation.

Businesses of all sizes suddenly have this opportunity. What can you accomplish during your ‘plant shutdown’? Well, for ideas – there are physical changes (rearranging a showroom, gym, or restaurant seating arrangement to allow more functional usage), periodic maintenance (steam your carpets, paint your walls, organize your warehouse) and business tooling/service improvements you can make. Are you paying too much for your website, your payment solution, or your inventory management tools? Not all of these projects require significant investment, and it’s likely that some leg work today could save you money down the road.

Time and elbow grease could upgrade your physical space. Building a beautiful, more flexible site on Squarespace or Wix could reap benefits as customers experience your online storefront for months or years. Explore whether you’re using the best payments solution. What other tools do you use to run your business that you could evaluate right now?

Most businesses get one chance to make these decisions as you start operation, and the switching cost is very high once you’re locked in -mostly because change requires closing your business for some period. The quarantine might have forced the closure – take advantage!

-Build your skills – In my decade of experience working with small businesses (small ecommerce merchants with eBay, cash-flow solutions with Kabbage, and I currently work with Drum, focusing on providing new ways for businesses to market themselves), I’ve learned people start and operate businesses because they believe in their core mission, not because they’re a magical jack-of-all-trades superhuman.

Retailers sell things they love to produce and curate. Restaurateurs create amazing dining experiences. Contractors are able to bring remodels and renovations to life. In an ideal world, entrepreneurs should spend as much of their mental and physical energy on the thing they’re really good at and leave the other elements of a business to others.

Unfortunately, this isn’t the reality that most business owners live with. There’s always more work to be done than there are hands to do it, and any business owner wears multiple hats – you can’t offload everything. I’m sure there’s a hat every business owner wears that doesn’t fit so well.

If your poorly-fitting hat is marketing-related, maybe a few weeks of couch time is great for pouring over free marketing tutorials (courtesy of LinkedIn Learning/Lynda.com). If you struggle with keeping your financials straight and organized, maybe this is a great time to dive headfirst into QuickBooks resources. Even better – leverage the collective power of the internet (particularly Twitter, LinkedIn, and Facebook) to find a subject matter expert. You may find a similarly stir-crazy professional with knowledge you’re looking to develop that’s willing to provide some free/low-cost advice or trade some consulting hours for business services or products.

There are no easy answers – we’re all going to muddle through the next weeks and months together. But business owners are resilient, and they’re resourceful – I’m sure there is no shortage of brilliant ideas floating around. See what these suggestions could do for you, then pay it forward – share your own ideas, whether on social media or directly with your contacts.

Customs Providing Immediate Short-Term Duty Deferrals to Approved Importers Working to Provide Longer Term Relief to the Importing Community

Short term case-by-case relief to approved importers: On Friday, March 20, 2020, Customs issued the following message:

Due to the severity of Novel Coronavirus Disease (COVID-19), U.S. Customs and Border Protection (CBP) will approve on a case by case basis additional days for payment of estimated duties, taxes and fees due to this emergency. Please note we are working on a future message that will provide further information. Please watch your CSMS messages.

NOTE: CBP has confirmed that the March 20, 2020 debit authorizations for the Periodic Monthly Statements and the daily statements have been transmitted to the Department of Treasury. Please work directly with your financial institution if you wish to prevent these funds from being withdrawn.

Requests should be directed to the Office of Trade, Trade Policy, and Programs at OTentrysummary@cbp.dhs.gov.

We are advised that companies sending requests for “additional days” are receiving responses from CBP such as the following:

Thank you for your message. Yes, you are approved for additional days for payment due to the COVID – 19 emergency. Please note we are working on a future message that may provide an additional timeframe for payment. Please watch your CSMS messages. Please let me know if you have any additional questions.

Based on the above CBP Message and anticipated response, our comments and suggestions for companies seeking “additional days” for payment of duties are as follows:

-CBP does not specify the number of “additional days” in its Message or the response; however, we are advised that for the time being Customs is granting an additional 10 days to specifically approved companies.

-The message does not specify the information to be provided in the request. At a minimum, companies requesting additional days for payment of duties, taxes, and fees owing should include the exact company name and their Importer of Record (IOR) number with the request. Additionally, it may be prudent to include a brief statement specifying the company’s need for the additional time requested and the harm that the company is currently facing.

-The CBP Message advises companies granted additional days to “work directly with your financial institution.” Even if CBP grants the additional days requested, Customs at this time does not have the ability to stop its automated system from requesting the transfer of funds (duties, fees, taxes) from designated bank accounts for specific companies. As such, the company responsible for payment of the duties and fees will need to coordinate with its bank (i.e., its financial institution) in advance so that the bank will block incoming funds transfer requests from CBP. We are advised that CBP’s system normally transmits electronic payment requests three times, so the bank should be prepared to block transfers in response to all three incoming CBP requests.

-CBP’s system automatically generates liquidated damages notices for non-payment and late payment of duties, fees and other amounts owing. Companies receiving “additional days” for payment of amounts owing should expect to receive such notices. We understand that providing the CBP authorization message to the approved party should be sufficient to cancel any such notices in their entirety (assuming that the amounts owing were fully paid within the extension period).

-The CBP Message covers “estimated duties, taxes, and fees.” We are not aware that it provides additional time for the payment of penalties, liquidated damages or other amounts that may be owing CBP.

-We are aware that industry groups have identified different parties for the “additional days” request other than the party identified in the CBP Message (OTentrysummary@cbp.dhs.gov). At this time, we recommend that companies seeking additional days should use the email address specified in the CBP Message.

Likelihood of longer-term (90-day) relief to the importing community: In response to ongoing discussions and requests by several trade organizations CBP is considering a 90-day extension that would be applicable to the larger importing community. Essentially, this would align duty payments with the 90-day extension currently granted by the IRS to tax filers. We expect CBP to issue a Federal Register concerning this broader extension policy in the near future and will provide updates accordingly.

Maintaining Business-as-Usual When Nothing is Usual

As we watch the evolving global response to the COVID-19 pandemic, it is abundantly clear that organizations are facing a business continuity challenge for which most had not precisely prepared. With little to no strategic planning for it, organizations are being forced to shift from an on-premises employee base to a remote distributed workforce. The choice is clear, shift or shut down, and those trying to shift have significant hurdles to overcome. Enterprises need to protect their employees and ensure business operation continuity by making this immediate pivot to a remote workforce.

The aforementioned hurdles are numerous, indeed. A few key ones fall around maintaining compliance, ensuring security with developmental practices and keys, and maintaining visibility into risk when monitoring tools are overwhelmed with signals.

Uncompromised Compliance

Meeting compliance rules in a diverse IT ecosystem is arduous on the best of days but can be overwhelming for organizations dealing with the unanticipated tide of remote workers, non-controlled devices, and unmanaged locations. Yet without access to the business-critical and sensitive information required to perform job responsibilities, productivity would grind to a halt.  Organizations meet the competing priorities of employee access and regulatory compliance in spite of an ongoing pandemic. Compliance frameworks such as SOX, HIPAA, HITECH, and PCI, require implementing and monitoring a large number of controls to ensure compliance, even with remote workers. This is a herculean task, especially across multiple clouds, sites, and external work locations.

In order to establish compliance, many compliance frameworks require organizations to begin with a risk-based assessment of the ecosystem. The information gathered from this assessment determines what controls are necessary and how they can best be configured to integrate with the environment. For organizations needing to move swiftly, it is absolutely essential to utilize automated tools to manage this process and ensure that no controls are left out or partially implemented. Even after implementation, the ecosystem should be reviewed and monitored in order to maintain continual compliance.

Remote Development

Developers working from home come with the challenge of ensuring the codebase that they are working on is secure and that it can safely be moved through the development lifecycle. Fortunately, developers have already been moving down this path with the development lifecycle in the cloud using a CI/CD pipeline to streamline and automate the process from development to production. However, this requires the issuance of high-privileged keys to developers to move code between environments and execute the code. Protecting these privileged keys is challenging and can leave individuals with excessive rights that violate the principle of least privilege. In the worst scenario, a bad actor could insert malicious code, self-promote the code all the way into production, and have the code execute with a permanently issued privileged key, all without any checks along the way.

The best way to ensure that the CI/CD pipeline remains secure is to ensure there are zero standing privileges when they are not directly needed to perform functions in the environment. To aid in this effort, storing privileged keys and using a system to programmatically check them out at the time of code execution allows them to be available when needed but otherwise keeps them inaccessible. This can further be improved upon by using scoped keys that have an expiration built into them so that even if a high-privilege key was compromised, its ability to be utilized by bad actors is limited.

In order to maintain compliance, it’s also important for a solution to see and control when a developer may have a risky or toxic combination of access, such as the capability of both writing code and performing QA on that code. Keeping these duties separate is key to preventing poor code hygiene, and it also reduces the risk of a backdoor being written in and pushed into production.

Pinpointing Anomalous Behavior

When dealing with multiple external workers and the sudden change in traffic, the vast amount of real-time activity and behavior data coming in from different areas can complicate visibility into anomalous behavior. An IT ecosystem that ranges from on-premises assets to multiple clouds generates a huge volume of log data, and SIEM tools and vulnerability scans only add to the total. Each of these is generally contained in its own environment and has separate interfaces for reviewing and monitoring, and there is limited correlation to find anomalies that might not be readily apparent from any given individual interface.

While managing a strong remote work environment, an organization is going to need to double down on monitoring. In order to understand holistic risk and keep from missing trends only visible when broader data is analyzed, organizations should seek ways to integrate the data from these disparate systems to attain visibility not possible from looking at each as a silo. A quick response can make the difference between a bad actor being stopped cold and walking off with the keys to the kingdom.

When Business IS Usual

Whether adapting to a pandemic or evolving to follow the trend of offering remote work to attract top talent, ensuring your organization’s data is secure is top priority. Even when the IT landscape of your organization changes, you need to maintain business continuity with solutions that include automated response to risk while documenting continual compliance. Whether securing file access or enabling software development, ensuring only the right people have the right access to the right digital resources at the right time should be more than a clever catchphrase. It should be business as usual.
